These terms govern your use of the uppingdigital.com website and the free offers presented on it. They are not the contract for our managed services — paid services are governed by a separate agreement signed with each client, which prevails over this page.

2. Using this website

You may browse this site and use its forms to contact us. You agree not to: attempt to gain unauthorised access to any part of the site or its infrastructure; submit forms automatically or in bulk; submit another person's data without their permission; or use the site in a way that damages it or interferes with other visitors.

3. The free basic pentest

We offer a free external, non-intrusive assessment of an internet-facing domain. By requesting it you agree that:

• You own the domain you submit, or you are authorised by its owner to request an assessment of it. We may ask you to confirm this in writing before starting.
• The assessment observes what is publicly exposed. It does not exploit vulnerabilities, does not attempt to access data and is not a full penetration test.
• It is a point-in-time snapshot with limited scope. It does not certify that your systems are secure, and a clean report is not a guarantee that no vulnerability exists.
• Availability is limited by our monthly capacity and we may decline or postpone a request.
• The report is provided for your own use. Acting on its findings — or not acting — is your decision and your responsibility.

If we identify serious issues we may offer a paid, in-depth engagement. You are never obliged to accept it.

4. Prices and quotations

Prices shown on this website (including UppingShield per-endpoint pricing and Business Suite plans) are indicative, stated in US dollars, and may change. They do not include taxes unless stated. A binding price exists only in a written quotation or signed agreement. Managed plans are quoted individually because they depend on your environment.

5. Content and intellectual property

The content of this website — text, layout, graphics, the Upping Digital and UppingShield™ names and logos — belongs to Upping Digital and may not be copied or reused commercially without our written permission. Third-party names and trademarks mentioned belong to their respective owners; mentioning a vendor does not imply endorsement or partnership beyond what is expressly stated.

6. Accuracy and availability

We work to keep this website accurate and available, but we provide it "as is". Statistics, indicative figures and example scenarios are illustrative. We do not warrant that the site will be uninterrupted or error-free.

7. Limitation of liability

To the maximum extent permitted by law, Upping Digital is not liable for indirect, incidental or consequential damages, or for loss of profit, revenue or data, arising from the use of this website or from the free assessment. Nothing in these terms limits liability that cannot be limited by law. Liability arising from paid services is governed by the applicable service agreement.

10. Governing law

These terms are governed by the laws of the State of Florida, United States, and disputes are subject to the courts of Hillsborough County, Florida, without prejudice to any mandatory consumer protection rights you have in your country of residence.
